ADA Successfully Lobbies to Block Medicaid Cuts

After aggressive lobbying by ADA, the House Energy and Commerce Committee approved unanimously HR 5613. The bill blocks seven rules proposed by the Bush Administration designed to cut federal Medicaid payments to the States. The bill would postpone the regulations until April 2009, when a new president will be in office.

The Bush Administration proposed the rules last year in an attempt to prevent the states from engaging in certain practices, such as billing the program for transporting Medicaid eligible children to school or helping patients find jobs or housing as part of “case management.” The Bush Administration argued that they are using current rules to maximize payments.

President Bush delivered a veto threat to Congress in a letter on April 15 from Health and Human Services Secretary Michael O. Leavitt but ADA believes House support is strong enough to override the President’s veto. The bill is scheduled for floor action this week.

The action then moves to the Senate where ADA anticipates the bill will pass but is less certain Democratic leaders can overcome the President’s veto.
